Terms of Service - Built Correct

Please read these Terms of Service ("Terms") carefully before using services provided by Built Correct LLC ("Company," "we," "our," or "us").

By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. SERVICES PROVIDED

We provide custom software solutions, administrative tools, and related services, including Build Rooms on builtcorrect.com, our project chat, and our mobile apps ("Services"). All Services are provided "as-is" and we reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without notice.

2. BUILD ROOMS

A Build Room is a chat on builtcorrect.com and in our app where you describe what your business needs and we build it with you. This section applies to every Build Room, along with the rest of these Terms.

Who answers. Replies come from our AI assistant, labeled "AI," or from our team. Our engineers oversee Build Rooms and may read your room, look at your app, and join the conversation to help you or to keep our Services safe.
AI can be wrong. Apps and replies in a Build Room are made with AI and may contain mistakes. Check an app before you rely on it, especially for prices, payments, safety, or legal requirements. Nothing in a Build Room is legal, tax, financial, medical, or other professional advice.
Apps start as public links. Each app built in a Build Room gets its own web address, and anyone with the link can open it. Do not put passwords, payment card or bank details, government ID numbers, health information, or other sensitive personal information into a Build Room or an app built in one. If your app collects information from other people, such as your customers, you are responsible for having the right to collect it and for telling them how you use it.
Free to start, with limits. Build Rooms are free to start, with limits on rooms, apps, and updates. We decide when to unlock more, and we may change or end free limits at any time. Free use comes with no promise of availability or speed, or that an app stays online. We may take down an app or close a room that breaks these Terms or has gone unused for a long time.
Paid apps. If you want an app to become a full app for your business, for example with sign-in, your team, and your records, we will agree on the price with you before you are charged. Payment and Billing below then applies, and your Build Room stays the place to ask for changes.
Your content stays yours. You keep ownership of what you put into a Build Room: your messages, photos, files, voice notes, and business data ("Your Content"). You confirm you have the right to share it. You allow us to store, copy, display, and process Your Content, including with the AI services described in our Privacy Policy, to run your room, build and host your app, support you, keep our Services safe, and improve our assistant's replies.
Your app. You may use the app built in your Build Room for your business while you use our Services. The code, designs, templates, tools, and methods we use to build and run apps remain ours, and we may reuse general designs and components that do not contain Your Content.
Reports and removal. You can report an AI reply by tapping its "AI" label. We have zero tolerance for objectionable content and abusive users, and we may remove content, close a room, or end an account that breaks these Terms, without notice.
Deleting your account. You can delete your account at any time from your Build Room or as described on our Delete your account page. This deletes your account, the Build Rooms saved to it with their chats, and the apps built in them. We may keep limited records where we need them for security, accounting, or legal reasons.

3. USER ACCOUNTS

You are responsible for:

Maintaining confidentiality of your account credentials
All activities that occur under your account
Ensuring your account information is accurate and current
Notifying us immediately of any unauthorized access

You may not share account credentials or allow unauthorized access to your account. You must be at least 18 years old to create an account or use a Build Room.

4. ACCEPTABLE USE

You agree not to:

Use Services for illegal purposes or in violation of any laws
Attempt to gain unauthorized access to our systems
Transmit viruses, malware, or harmful code
Interfere with or disrupt Services or servers
Harvest or collect information about other users
Impersonate others or provide false information
Violate intellectual property rights
Use Services to spam or harass others
Use bots, scripts, or multiple accounts or addresses to open Build Rooms, get around limits, or overload our Services
Try to make our AI produce illegal, harmful, hateful, sexual, or deceptive content, or reveal its instructions or anyone else's information
Build or host apps that imitate another business or person, collect passwords or payment details under false pretenses, or otherwise mislead people
Upload content you do not have the right to share, post objectionable content, or abuse anyone, including our team

5. PAYMENT AND BILLING

Subscription fees are billed monthly in advance. You authorize us to charge your payment method on file. Fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice. Failure to pay may result in service suspension or termination. For a paid app that starts in a Build Room, we agree on the price with you before you are charged.

6. INTELLECTUAL PROPERTY

Except for Your Content and unless a separate written agreement with you says otherwise, all content, features, and functionality of our Services, including the code and designs of apps we build, are owned by Built Correct LLC and protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use Services, including apps built for you, for their intended purpose. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. DATA AND PRIVACY

Your use of our Services is governed by our Privacy Policy. We use Amazon Web Services (AWS) for hosting and data storage, which provides industry-standard security and encryption. While we implement reasonable security measures, we cannot guarantee absolute security.

We do not store customer data on personal devices or unsecured systems.

8. DISCLAIMERS AND LIMITATION OF LIABILITY

SERVICES ARE PROVIDED "AS-IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

Services will be uninterrupted, secure, or error-free
Results obtained will be accurate or reliable
Defects will be corrected
Services will meet your specific requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILT CORRECT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. INDEMNIFICATION

You agree to indemnify and hold harmless Built Correct LLC, its officers, members, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of Services or violation of these Terms.

10. MODIFICATIONS TO SERVICES AND TERMS

We reserve the right to modify or discontinue Services at any time without notice. We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via email or prominent notice on our website.

11. TERMINATION

We may terminate or suspend your access immediately, without notice, for any reason, including breach of these Terms. Upon termination, your right to use Services ceases immediately. Sections that by their nature should survive termination will remain in effect.

You may cancel your subscription at any time. No refunds will be provided for partial months. You can also delete your account at any time, as described in Build Rooms above.

12. THIRD-PARTY SERVICES

Our Services may contain links to third-party websites or integrate with third-party services. Some features rely on third-party services, such as the AI providers named in our Privacy Policy, Sign in with Google, and payment processors, which handle information under their own terms. We are not responsible for the content, policies, or practices of third parties.

13. DISPUTE RESOLUTION AND GOVERNING LAW

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in New Jersey.

14. FORCE MAJEURE

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or interruptions in telecommunications or internet services.

15. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any separate written agreement between you and Built Correct LLC, constitute the entire agreement between you and Built Correct LLC regarding use of Services. If a separate written agreement conflicts with these Terms, the separate agreement controls.
